  • This agreement (“Agreement”) constitutes a binding contract for event rental services. Triangle Backyard Cinema is a service of Mad Science Industries, Inc. DBA Oak City Films.

    By signing this Agreement, the clients, identified above and signed below (collectively referred to below as “Client”), individually and severally, agree to pay Oak City Films (collectively, the “Company”) for the services and/or products (collectively referred to as "Services") provided by the Company at the price stated below. The following terms and conditions shall also apply to Client’s engagement of the Company:

    1. CANCELLATIONS AND RESCHEDULING

    You may cancel your event up to 14 days prior to your event without penalty.
    Cancellations after 14 days prior to your event will receive a 50% refund.
    Cancellations within 48 hours of the event will not receive a refund.

    You may reschedule for non-weather related reasons up to 7 days prior to your event to any open date without penalty.

    Rescheduling for non-weather related reasons within 48 hours of the event will result in a $50 rescheduling fee.

    2. WEATHER POLICY

    We want you to have a fantastic time at your event and that means we need great weather. Poor weather can affect your enjoyment and potentially damage our equipment.

    You may reschedule your event anytime up to 4pm or 3 hours prior to your expected movie start time (whichever is later) on the day of your event due to weather or expected weather. You may move to any open weekday (M-TH) within 6 weeks of your original event date or any open weekend date (FR-SU) within 4 weeks of your event date. There is no fee for rescheduling due to weather or reasonably expected weather.

    We may reschedule your event at our option due to weather or expected weather at any time. We will only do this in an abundance of caution for your safety and enjoyment.

    If we ask to reschedule and you would prefer to "risk it,” keep in mind that if your event is ended prematurely due to weather you may reschedule but you will need to pay a rescheduling fee of $75. There will be no refund of money previously paid in this case regardless of if you choose to reschedule. We reserve the right to delay or end an event due to weather. You will not be charged a reschedule fee if the weather event was unforeseeable and we had not requested to reschedule previously. We will reschedule to a new date in this event.

    Alternatively, we do have an indoor 120 inch screen if you'd like to move your event indoors and keep your event date as planned. You may opt for this option if preferred to a reschedule.

    3. CLIENT RESPONSIBILITIES

    Standard 3 prong outlet (15 amp+) within 200ft of your desired location

    Your movie (DVD, Blu-ray (preferred), or streaming account)
    Our projector accepts input from any HDMI device
    For gaming, you will need to provide the console and game Access to an indoor bathroom for technician

    5. WORK ENVIRONMENT

    Client must provide a safe working environment and is responsible for any damage to equipment done by Client or guests, invited or otherwise.

    In the event of circumstances deemed to present a threat or implied threat of injury or unprofessional, harassing language or behavior to Studio's staff, Studio will make reasonable efforts to notify the Client. If the Client is/are able to respond to the threatening situation to the satisfaction of the Studio in a reasonable amount of time, Studio shall resume work in accordance with the original terms of this Agreement. If the inappropriate behavior continues, the Client will agree to relieve and hold Studio harmless as a result of incomplete services under this Agreement. The Client(s) shall be responsible for payment in full, regardless of whether the situation is resolved or whether Studio resumes work detailed in this Agreement.

    5. LIMIT OF LIABILITY

    In recognition of the relative risks and benefits of the Event to the Company, the risks have been allocated such that the Client agrees, to the fullest extent permitted by law, to fully indemnify and hold the Company and its officers, directors, partners, employees, shareholders, owners, and subconsultants harmless for any and all claims, losses, costs, damages of any nature whatosever whether arising from breach of contract, negligence, or other common law or statutory theory of recovery, or claims expenses from any cause or causes, including attorney’s fees and costs and expert witness fees and costs. In any event, the total aggregate liability of the Company and officers, directors, partners, employees, shareholders, owners and subconsultants, shall not exceed the Company’s total fee for the Event.

    It is intended that this limitation apply to any and all liability or cause of action however alleged or arising, unless otherwise prohibited by law, including but not limited to negligence, breach of contract, or any other claim whether in tort, contract or equity.

    Limitations on liability, waivers and indemnities in this Agreement are understandings between the parties and shall apply to all legal theories of recovery, including breach of contract or warranty, breach of fiduciary duty, tort (including negligence), strict or statutory liability, or any other cause of action, provided that these limitations on liability, waivers and indemnities will not apply to any losses or damages that may be found by a trier of fact to have been caused by Company’’s gross negligence or willful misconduct. In no event will Client will seek aggregate damages in excess of the contractually agreed-upon limitations, directly or indirectly, through suits against third parties who Client seeks to join as co- or third-party defendants.

    6. COPYRIGHT

    Client agrees to indemnify and hold the Company harmless for any loss, damage, or liability for infringement of any rights arising from the use of the equipment. Client must supply their own content and are responsible for any applicable licenses for their event if any are required.

    7. COVID PROCEDURES

    For your safety and ours, we will wear a mask anytime we need to enter an interior space or interact with you or any guests within approximately 15ft. We may remove our mask at substantial distances from you in an outdoor environment unless requested not to do so.

    We request that you wear a mask when interacting with technicians at close distances (such as to connect AV equipment to projector).

    No one in your party should attend that has felt any symptoms of illness in the past 14 days
